The work zone will occur behind temporary concrete barrier, which, in most locations, includes a travel lane and shoulder. The existing pavement in this area will become damaged due to heavy construction equipment. Is it the intent of the department that this asphalt be milled and paved at the contractor's expense or will this repair be paid under existing bid items 0890 Flexible Pavement Planing 0"-2" and 0350 Asphalt Concrete Ty. SM-12.5A?

The damage and repair of pavement in the work zone is the responsibility of the Contractor and at the Contractor's expense per Specification Section 105.

The updated Form C-48, revised on 10-03-25, states "All vendors submitting a bid as a Prime Contractor shall complete and submit with their bids the following information as requested for (1) Subcontractor/Supplier Solicitation, and Utilization, and (2) for Vendor Survey." The note on page two of Notice 04, issued 10-10-25, states "The updated Form C-48 must be submitted in accordance with current specifications SP107-001510-04." Specification SP107-001510-04 states "Form C-48 must be received no later than 10:00 a.m. the next business day after the date and time stated in the Invitation for Bids, or the bid will be rejected as non-responsive." Does the completed Form C-48 need to be submitted with the bids (i.e. via Bid Express) or can it be submitted via email by 10:00 a.m. the next business day after bid opening?

Pay Item #890 - Flexible Pavement Planing 0"-2" is for the conditional post-traffic shift overlaying of I-264 WB between the Downtown Tunnel and the MLK Interchange (see Sheet 1H(9)). The contractor will need to assess the condition of the pavement and confirm with the Department if the overlay is needed.

The end of the project is shown on the plans at sta. 262+72.71, which is a significant distance from the Downtown Tunnel. Based on your answer to the previous question, it appears the Flexible Pavement Planing will continue outside of the project limits. In addition, there appears to be no bid item for the new asphalt and pavement markings for re-paving this area. Please confirm that this is the intent and that it will be part of this contract.

SP108-000150-00 states that the Department will pay an incentive of $11,000 per calendar day the project meets the Substantial Completion requirements on or before the Substantial Completion Date. The incentive is capped at $660,000. If the Contractor does not achieve Substantial Completion on or before the Substantial Completion Date, the Department will assess a disincentive in the amount of $11,000 for each calendar day, including Sundays and Holidays, that the project does not meet the requirements of substantial completion as defined herein. There is no mention of a cap on the disincentive. Is the disincentive capped at a certain dollar amount?

As the provision reads in Section III, the $11,000.00 disincentive assessment will begin at midnight October 23rd, and will continue to be assessed each day until substantial completion is achieved. If Substantial completion is not achieved before the Fixed Com-pletion Date, liquidated damages shall be assessed concurrently with the Substantial Completion Disincentive. The disincentive amount is not capped.
