The SP0F0-000150-01 of the Contract Documents includes: (1) the [Notice of Requirement for Affirmative Action to Ensure Equal Employment Opportunity] and (2) [Standard Federal EEO Construction Contract Specifications]. It appears that both documents are based upon Executive Order 11246. Executive Order 11246 was revoked by Executive Order 14173. Given this, please confirm that these documents and any other provisions in the Contract Documents based on Executive Order 11246 do not apply to this Project, will not be enforced, and will be removed from the Contract Documents via amendment.

The requirements of Executive Order (EO) 11246 will remain in this contract. The Department recognizes that Presidential EO 14173 (1/21/2025) revoked EO 11246 (Equal Employment Opportunity). However, EO 14173 is directed to Federal agencies, and implementation of the new EO requires Federal agencies to issue new guidance. As of this date, FHWA has not issued any guidance or revised its rules and regulations to implement EO 14173. Therefore, until such time as FHWA issues new guidance or revises its rules and regulations, VDOT will continue to comply with current Federal program requirements and incorporate those requirements into its federally funded contracts.

On Sheet 8(3) of the plans, the HDPF grout treatment bottom elevation is -21’ (approximately 30 feet below the bottom of the wall). Please confirm this bottom treatment elevation for the HDPF is to be applied between Station 29+00 to 36+00 below the existing wall.
